Minimum Standard of Care / Gross Negligence

Client’s former employer submitted a complaint to FDOH alleging Client, a Registered Nurse, failed to follow physician orders.  Resident transferred to hospital for services secondary to respiratory failure.  The case was closed at PCP with no probable cause found

Client, a Registered Nurse, was reported by a former employer for practicing outside the scope for administering Phenergan when the order was for Zofran.  Patient reported a history of adverse reaction to Phenergan.  Case closed with a Letter of Guidance at PCP.  Letter of Guidance remains confidential and is not discipline.

Failure to Report Patient Abuse

Client, a Registered Nurse, was reported to FDOH for failing to timely report known alleged patient abuse.  Response to allegations noted that it was not the client’s employer who reported the matter, that the client continued in his/her current position, and others above her where aware of and had addressed the situation.  Case closed with a Letter of Guidance at PCP.  Letter of Guidance remains confidential and is not discipline.

Drug Diversion / Possible Impairment

FDOH received a complaint accusing a licensed registered nurse of suspected drug diversion.   Former employer referred client to IPN (Intervention Project for Nurses) and reported the matter to the Department.  Case closed with a Letter of Guidance for inaccurate recording at PCP.  Letter of Guidance remains confidential and is not discipline.

FDOH received a complaint from DCF alleging my client, an LPN, provided negligent patient care regarding medication administration.  We obtained a copy of the DCF report and submitted a detailed response package with reference letters. The case was closed at PCP with no probable cause found.

Client’s former employer, Mayo Clinic, submitted a complaint to FDOH alleging multiple medication administration discrepancies.  We submitted a detailed response to the allegations defending our client’s RN license and the case was closed at PCP with no probable cause found.
