Important Information for all Licensees:

Investigation Letter: Once you receive a letter from the Department of Health Investigator notifying you that your license is under investigation for alleged violations of the practice act the clock starts ticking.  The letter will ask you to provide a copy of your curriculum vitae (your resume) and submit a response.  Do not make the common mistake of thinking that this is not a very serious matter or that you did not do what you are accused of and file your own response.  Everything you say will be used against you by the prosecuting attorney for the Department of Health.

When you first receive the letter of investigation that is the best time to call for a free initial consultation to discuss the administrative process and your options.  While the letter says that you have 20 days to respond if your case is deemed a high priority case the process moves very quickly with possible emergency action taken against your license.   Contacting an attorney at the early stages of the investigation is vital for protecting your rights.

If you receive this letter, call Megan Blancho immediately for a free consultation.

This is a critical stage to hire an attorney that is familiar with the Department of Health’s procedures.  Once retained, Megan will immediately file a letter of representation with the investigator and demand a copy of the confidential investigative file before filing a response on your behalf.  If at all possible we will seek to have the matter closed at the private probable cause panel so that a public administrative complaint is not filed against your license.

Experience on your Side

Megan has years of experience as a former prosecuting attorney for the Department of Health.  For several years Megan was a supervising attorney in the Prosecution Services Unit traveling throughout the state of Florida and presenting at every Board meeting.  The Board determines the discipline of the licensee and reviews every settlement agreement signed by the licensee and the Department of Health and reviews the decisions of the administrative law judge should the case proceed to a hearing. All cases are prosecuted from the Tallahassee office of the Department of Health and Megan will represent your interests regardless of your location throughout the state of Florida.

The Department of Health has attorneys reviewing your case, making the recommendations to the panel members whether or not to file an administrative complaint, prosecuting the case before the judge, and presenting the matter to the Board.  Do not go it alone.  Experienced legal representation is vital.  Megan is willing to work with licensee’s on payment plans knowing that they are already experiencing a difficult time and if an administrative complaint is filed will be responsible to pay the costs of the investigation by the Department of Health.

PRN - Professional Resources Network

PRN stands for Professional Resources Network and is the impaired practitioners program for all licensees other than nurses. Nurses are monitored by IPN. PRN communicates directly with the Department of Health. Before signing a release, submitting to an evaluation, or entering a monitoring contract, contact Megan Blancho to discuss the process and options.

You are required to notify the Board in writing within 30 days of entering a plea of nolo contendere or guilty, regardless of adjudication to any criminal charge in any jurisdiction The failure to timely report is automatically a basis for an administrative complaint but not all pleas to criminal charges is a basis for a complaint.  Call today to discuss your pending or prior criminal charge for more information.  Many criminal defense attorneys can assist you with your criminal case but have little to no knowledge about the impact on your medical license.  Megan has worked with licensee’s and their attorneys on understanding the impact of different charges on the nursing license and can assist at any stage in the process.
