Arrest Triggers Employment Exclusion – Exemption Application
If you are a healthcare professional in Florida and are arrested for Domestic Violence or other disqualifying employment offenses, your arrest triggers a mandatory employment exclusion with AHCA (Agency for Health Care Administration). This employment exclusion prohibits you from working for any facility throughout Florida that accepts Florida Medicaid while the case is pending.
If you enter a diversion program the employment exclusion continues until the case is finalized. I prepare a mitigation letter explaining the unique circumstances that you are in as a Florida nurse, doctor, or other healthcare licensee, seeking an expeditious and beneficial outcome in order to seek reinstatement of your employment privileges.
If the charge is dismissed, an exemption is not needed, and I seek reinstatement of your employment privileges with AHCA.
Exemption Needed: If you enter a plea to Domestic Violence or other employment disqualifying offense, your employment disqualification continues until certain conditions are met and you obtain an exemption from your professional healthcare licensing board. AHCA approves exemptions for unlicensed individuals working in facilities that accept Florida Medicaid (example: nursing students completing clinicals.) If you are licensed by a Florida Department of Health Board, the Board reviews exemption applications. We have the burden to prove that you are rehabilitated under statutory requirements to obtain an exemption.
